Viapoint Terms of Use
Effective date: [EFFECTIVE DATE]
These Terms govern your use of the Viapoint mobile app and related services (“Viapoint”, “the service”), operated by [OPERATOR NAME], [COUNTRY] (“we”, “us”). By creating an account or using Viapoint you accept these Terms and our Privacy Policy. If you do not agree, do not use the service.
1. What Viapoint is
Viapoint lets travellers publish photos with the exact place and direction of shooting, find interesting places and shooting spots on the map and save them for trip planning. Content is created by travellers; Viapoint has no ads, paid promotion or business accounts.
2. Who can use Viapoint
- You must be at least 16 years old.
- You must provide a phone number that belongs to you and confirm it with a one-time code.
- One person — one account. Do not create accounts for others, do not sell or transfer your account.
- You are responsible for everything that happens under your account. If you think someone else has access to it, tell us at viapointsupport@gmail.com.
3. Your content
Ownership. Photos, descriptions and other content you publish remain yours.
Licence to us. By publishing content you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, resize, display and distribute it within Viapoint, solely to operate, show and improve the service. The licence ends when you delete the content or your account, except for copies that remain for a limited time in backups (see the Privacy Policy) and content that other users have already seen.
Your promises. By publishing content you confirm that:
- you took the photo yourself or have the right to publish it;
- publishing it does not violate anyone’s rights — copyright, privacy, image rights;
- people who can be clearly identified in the photo do not object to its publication, and you comply with the laws on photographing people in your country and the country of shooting.
Location is public. Every photo is shown with the exact place where it was taken, the direction, date and time. Before publishing, make sure this does not reveal your home or anyone’s private life. Do not publish photos taken at home, at other people’s homes, at children’s institutions or in places where photography is prohibited.
4. What you must not do
Do not publish content or use Viapoint to:
- break the law or encourage others to do so;
- publish nudity, sexual content, violence, cruelty, hate, discrimination, threats, harassment or bullying;
- publish personal data of others without their consent (addresses, documents, phone numbers, car plates);
- publish content that endangers people — for example, encouraging access to closed or dangerous areas;
- advertise or promote goods, services, businesses or venues, spam, or artificially boost content;
- impersonate other people or organisations;
- publish content that is not a real travel photo, or fake the location or time of shooting;
- interfere with the service: hack, overload, collect data automatically (scraping), bypass restrictions.
5. Moderation and complaints
We have zero tolerance for objectionable content and abusive users.
- Any user can report a photo or another user in the app.
- Any user can block another user. After that neither of them sees the other’s photos, trips or profile details; the blocked user is not notified. A block can be removed at any time in profile settings.
- We review reports and remove violating content and accounts, usually within 24 hours.
- We may remove or hide content, limit features or block an account if it breaks these Terms or the law, and we may do so without prior notice when necessary for user safety.
- If you think we made a mistake, write to viapointsupport@gmail.com.
6. Places and safety
Viapoint shows where other travellers took photos; it does not check that places are accessible, open, legal to visit or safe. You visit any place at your own risk. Follow local laws, rules of private property and parks, and do not put yourself or others in danger for a shot. Information on the map may be inaccurate or outdated.
7. Third-party services
Viapoint uses Mapbox for maps and place search and Telegram for delivering sign-in codes. Their terms and privacy policies apply to your use of them. We are not responsible for third-party services.
8. Deleting your account
You can delete your account at any time in the app (Profile → Edit profile → Delete account) or by writing to viapointsupport@gmail.com. Deletion is permanent: your photos, trips and profile cannot be restored. We may suspend or delete an account that seriously or repeatedly breaks these Terms.
9. The service “as is”
Viapoint is in active development. The service is provided “as is” and “as available”: features may change, be temporarily unavailable or contain errors. Keep your own copies of your photos — Viapoint is not a backup service.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect damages, loss of data or profit, or damage resulting from your visits to places found in Viapoint, from content of other users or from third-party services. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory law.
11. Changes to these Terms
We may update these Terms. We will publish the new version with a new effective date and, for significant changes, notify you in the app in advance. If you keep using Viapoint after the changes take effect, you accept the new Terms; if you do not agree, you can delete your account.
12. Governing law
These Terms are governed by the law of [COUNTRY], without prejudice to mandatory consumer protection rules of your country of residence. Disputes are resolved by the courts of [JURISDICTION], unless the law of your country provides otherwise.
